4.3 Die Haftung von Roche für alle Schäden, die durch Verletzung einer bestimmten Garantiebestimmung

verursacht wurden, für Schäden, die gemäß dem Produkthaftungsgesetz auszugleichen sind, und für

Schäden durch Tod, Verletzungen oder Gesundheitsgefährdungen bleibt hiervon unberührt.

4.4 Der Lizenznehmer ist verpflichtet, regelmäßig Sicherungskopien anzulegen. Im Falle eines

Datenverlustes haftet Roche nur für die Kosten der Wiederherstellung derartiger Sicherungskopien.

5 Sonstiges

5.1 Änderungen an dieser Software-Lizenzvereinbarung bedürfen zu ihrer Wirksamkeit der Schriftform.

Dies gilt auch für alle Zusätze oder die Aufhebung dieser Schriftformklausel.

5.2 Diese Software-Lizenzvereinbarung unterliegt Schweizer Recht, unter Ausschluss der Regelungen

des UN-Kaufrechts und des Internationalen Privatrechts, die in gegenseitigem Einvernehmen

geändert werden können.

5.3 Ausschließlicher Gerichtsstand für internationale und inländische Rechtsstreitigkeiten aus oder im

Zusammenhang mit dieser Vereinbarung sind die Gerichte in Basel, Schweiz.

5.4 Sollten einzelne Artikel dieser Software-Lizenzvereinbarung unwirksam sein, bleibt die Wirksamkeit

der übrigen Bestimmungen davon unberührt. An Stelle der unwirksamen Artikel treten die gesetzlich

geltenden Bestimmungen.
